In this paper the issue in question is the wisdom of introducing an aggravated form of the availability of the advanced technological and communications or transport means in the field of organized crime. Especially as, on the one hand, it is difficult to specify further the scope of the term “advanced” which is required as to the technological means cited in the precept. And, on the other hand, it is questionable whether its means by itself will be sufficient to impose the more severe penalty. But certainly the greatest challenge to be faced in their practical application is the complex issue of delimiting this form vis-à-vis other precepts, which referred to the new technologies and provided for the possibility of introducing an aggravated criminal form in the field of criminal organizations or groups.
