The failure of our penal system in front of the problem of mass minor criminality has its origin in the lack of conciliation between the procedural reforms, which aim at the immediate prosecution of misdemeanor, and substantive rules. These have arisen by means of media headlines, i.e. as an answer to “professional criminality” which has been turned into some writing about the criminal type of common larceny which is difficult to apply.
