The rule of law, understood as principle of maximum certainty, allows the evaluation of legal texts and therefore, the evaluation of different kind of penalties. Because of this the legislative drafting can be understood as a question of degree of satisfaction of the rule of law and principle of proportionality, among others. Here different articles of the penal codes of Spain, Germany and Tasmania will be evaluated as example.
