Abstract

This research emphasizes the differences between probation and sursis. Moreover the author analyzes, from a critical perspective, the Spanish Criminal Law, both before and after the 1995 Code, and offeres several suggestions de lege ferenda in suspended penalties, substitutes and alternatives to the prison.
