Integration of mechanisms for the prevention of the crime of bribery in the current legal formula of corporate criminal compliance

Abstract

Although due to the reform of Organic Law 1/2015 on the subject of criminal liability of legal persons, there has been a noticeable increase in the number of criminal proceedings against legal persons, as well as in the effort corporations are putting in implementing compliance programs, the fact is that nowadays, there is no clear idea about how to implement these programs. The present work aims to approach some of the problems that arise when trying to put into effect the terms required by criminal law. This study centers on bribery because it is one of the crimes that companies run the highest risk of committing.
