Illegal financing of political parties and money laundering

Abstract

This work analyzes the introduction of the crime of illegal financing of political parties in the Penal Code 
in 2015. We make a critical judgment on the justification of its incorporation, we expose the main elements of the new 
crimes and we show several doctrinal criticisms. Next, we look at the possibility of punishing it with the crime of money 
laundering and we propose restriction criteria to prevent money laundering from being unduly extended. In addition, we 
mention the risks of instrumental use of judicial processes to resolve essentially political issues.
