Abstract

This article analyzes the new role of the victim in Criminal Law and Criminal Justice derived from the 
transposition of Directive 2012/29/EU of the European Parliament and of the Council of October 25, 2012, establishing 
minimum standards on the rights, support and protection of victims of crime. For this, the author makes a tour of the 
legislative and jurisprudential situation on the protection of the victim, and makes an detailed analysis of the legal status 
of the victim from the perspective of the new paradigm of Restorative Justice, balancing his reasoning in the search of 
solutions to satisfy needs in both the victim and the offender.
