Abstract

Assessing the appropriate amount of punishment in sentencing is a task that has become increasingly com-
plex. This has led to a lack of homogeneity in practice in Germany, which is made visible through various empirical
studies. The question of how to achieve greater consistency and uniformity in sentencing is now at the center of atten-
tion. In the following paper we will analyze the potential of the English Sentencing Guidelines to solve this problem.
