Authentic definitions of recklessness on road safety

Abstract

Organic Law (LO) 2/2019, of 1 March, modified the Criminal Code regarding reckless operation of motor vehicles and mopeds. Highlights among the related modifications include the introduction of three scenarios that will be considered serious recklessness under the law, as well as an authoritative interpretation of less serious recklessness. This work analyses the need and timeliness of authoritative definitions of serious and less serious recklessness, concluding that they are unnecessary, untimely and can generate confusion in the evaluation of cases of recklessness.
