Again on the interest legally protected by Section 290 of the Spanish Criminal Code

Abstract

This article got to take a position about the complex matter to establish which legal asset is protected in the Spanish penal code, article 290. This dilemma also determines the content of the criminal conduct. Therefore the legal assets proposed from doctrine are analyzed for argued they are wrong, but there are instead two legal assets in article 290: «the patrimony» as an individual interest, and «the document functionality» as a common interest.
