Implementation of reporting channels for sexual violence from a restorative perspective: legislative analysis Spain-Portugal

At a time when procedural efficiency has emerged as a powerful objective to be achieved, as evidenced by multiple reforms in recent years, the situation suffered by the Administration of Justice in Spain, in particular the criminal justice system, leads me to examine closely those matters that reflect an extension of the operation of the principle of opportunity in our legal system. Namely, on the one hand, the regulation of compliance programmes and, on the other, alternative dispute resolution, making up the two blocks of study of my research, which I will redirect more specifically to the reporting channels in the framework of sexual violence. In that way, I will connect Law 2/2023, of 20 February, with restorative justice, analysing the possible contributions that this latter current can make in this area and carrying out a comparative study with the Portuguese regulation.
