The police informer is an accepted means of investigation in practice, but with little regulation. The purpose of this article is to clarify the possible conditions that may occur in the use of covert means during the criminal investigation and later in the criminal proceedings. All of this with the aim of studying and seeking a balance between obtaining evidence derived from the use of police informants and respect for fundamental rights, in order to be able to use evidence with total guarantees, capable of enervating the presumption of innocence.
