Hidden camera in criminal proceedings

The use of hidden camera without the knowledge and authorization of the talker can assume an illegitimate intrusion into fundamental rights such as privacy and personal freedom and self-image, but this can not lead that has to be rejected for admission as lawful evidence in a criminal trial, but requires a weighting on the concurrence of a legitimate purpose authorized by the principles of necessity, rationality and proportionality. This study will analyze the requirements, both material and formal, that such evidence required in criminal jurisdiction.
