Abstract

The aim of this work is the analysis of the theoretical concept and of the practical impact of preventive justice. After a brief introduction to the inspiring idea of the article (1), the interrelation between security, prevention, risk and precaution is explained (2). Then the role and effects of the preventive logic in the field of criminal justice system will be exposed, as well as the theoretical linkage and its reflection in the criminal regulatory environment (3). In the next section, attention is placed on the significance of the preventive logic by the design of criminal policy and on the difficulties and possible limits for its intervention (4). This material is a basis for the analytical reading of the fiction story The Minority Report, an example of the pre-crime intervention (5). Finally, the criminal models inspired by the idea of a preventive justice will be discussed (6).
