Fines del proceso y persona jurídica: algunas consideraciones y propuestas a la luz de caso Volkswagen

Abstract

The “Volkswagen Case” is a clear example of the problem of criminal responsibility of legal persons. Firstly, the number of victims affected, in second, the economic and social importance of the imputed-legal person, because the sanction can affect not only thousands of jobs, but even the economic order of a country or certain countries and, thirdly, the difficulties which, at the procedural level, it generates the investigation and prosecution of a multinational company of such features. Therefore, it is necessary to arbitrate mechanisms enabling to speed up the achievement of the purposes of the criminal procedure.
