Sobre la realización iterativa de tipos penales y la necesaria delimitación entre la “unidad natural de acción” y el delito continuado

Abstract

Usually the descriptions of the offenses are made in singular, so it is difficult to determine how to punish criminal behavior when the behavior is repeated. To solve this problem is possible to use the figure of the “natural unity of action” or continuing offense. The demarcation between the two figures is complicated because their requirements are similar. Consequently, this study aims to clarify the scope of these figures, determining the requirements in each case.
