Women as victims of the so-called “gender violence” and the Draft Law in September 20, 2013, which would modify the Organic Law 10/1995, of 23 November, of the Criminal Code.

Abstract

The criminal protection women receive in the context of “gender violence” has been subject of several critical considerations both doctrinal and jurisprudential. After presenting the current regulation in this area and the critical considerations about it, in this paper I am making a personal assessment on both ends, as well as a summary of the changes proposed in this context by the Draft Organic Law in September 20, 2013, which would amend the Organic Law 10/1995, of 23 November, of the Criminal Code.
