Certain issues related to suspended prison sentences for dangerous, habitual or repeat offenders in the Penal Law Reform Project of 2013

Abstract

The suspension of sentences has suffered serious modifications in the Penal Law Reform Project of 2013, such as the disappearance of a substitution measure for prison sentences, which can be seen as a type of sentence suspension, among other modifications. This investigation is aimed at dealing with the problems that would arise from the law reform plan for this subject. For that, this work analyses the law texts where the new figure of a sentence suspension is established and it studies the so-called ordinary suspension, as well as cases of exceptional and special suspension, particularly in regards to habitual delinquents, repeat offenders and dangerous criminals.
