Dogmática jurídico-penal y Política criminal: una relación conflictiva, pero necesaria

Abstract

This article is about the relationsship between (Criminal) Policy and Legal Theory of Criminal Law in Germany in the second half of the XX. century. The political changes during this period of the history of Gemany after the Nationalsocialism and the Second World War have influenced as well the legal theory of the Criminal Law, called Penal Dogmatic. As well the last reforms in the fields of enviromental protection, financial crimes, corruption, organized crime and terrorism show that the relationship between Penal Dogmatic and Criminal Policy is a conflictive, but necessary relationship.
