This paper manifests the two main ways of thinking the phenomenons of crime and punishment. One as a history of ideas about punishment, and the other as a political economy of punishment. By opting for the second way as a method of reflection, in addition to elements brought from psychoanalysis, it follows that criminal law is unable to function as an instrument of crime control in contemporary neoliberal societies.
