Abstract

The objective of this article is twofold: First of all, to analyse the application of the European Union Directives, when they are in contradiction with the legislation of the Member States, which it is something possible through the principle known as “direct effect” of the European Union directives, even when they are environmental directives. Secondy, the article also examines the possible use of environmental directives, following the procedure mentioned above, to complete criminal law legislation for the protection of the environment in Spain. This analysis takes into consideration the most recent decision of the European Union Court of Justice as well as the directives on the use of criminal law for the protection of the environment in Europe.
