Abstract

The subject of this text is the current criminal policy developed in security key, rethought and redesigned with the purpose of, principally, the fight against insecurity rather than the prevention and punishment of criminal actions. After a preliminary warning directed primarily to dogmatic scholars (1.) the concept of securitization is explained (2.). Then their implications in the criminal law and criminal system (3.) as well as some criticisms that can be submitted to that concept will be offered (4.). In subsequent sections are described examples of securitization in Germany (5.), and cases that could be considered examples of securitization in the American context are mentioned (6.). To conclude some thoughts for future discussion are exposed (7.).
