Abstract

Article 379.2 of the Criminal Code sets an alcoholic impregnation rate to determine criminal behaviour. It is not a crime of endangerment. Driving under the influence of alcohol can not be inferred only by test results. The behaviour described in this crime is not to fulfil formal terms. That is, a technique nearly out of the principle of offensiveness.
