El terrorismo al amparo de la reforma efectuada por la Ley Orgánica 5/2010: concepto y elementos

Abstract

The reform of the Criminal Code realized by the LO 5/2010, of June 22 it has affected in a substantial and direct way to the regulation of the terrorism and of the terrorist crimes(offenses). One of the main and most important innovations takes root in the incorporation of a concept of organizations and terrorist groups that it contains the elements that traditionally had been identified by the doctrine and the jurisprudence On the other hand, the radical change that supposes going on from a national or sectorial terrorism to a religious, fundamentalist and global terrorism, it forces us to carry out an analysis of the essential notes of the same one in order to determine its adequacy or not to the concept and elements included in the Criminal code.
