In this paper we analyze the principles that should govern criminal guarantees with the incorporation of mediation victim offender as a mitigating circumstance, rule or requirement of suspension and replacement of the penalty and prison treatment modality from a perspective that, protecting the rights of the victim, to serve especially the social reintegration of offenders through the assumption of crime and the acknowledgment of the facts. We propose a universal system where the voluntariness of the parties and the balance between their interests, can be the focus of mediation programs before or during the process and during the performance of the sentence.
