The present article focuses on some controversial aspects of perpetration-by-means, with the aim of setting up the bases to enable its admissibility, both in intentional and negligent crimes. To this end, we analyze the scope of application of perpetration-by-means, and what we understand should be the requirements of the orchestrating which characterizes it, in order to broadly define the cases where the person behind the scenes can be held as a perpetrator
