Abstract

The notion of indirect perpetration through organised structures of powered developed by Claus Roxin in the sixties of the past century has come to play today in a number of international jurisdictions a key role in portraying the criminal liability of senior political leaders and high military commanders that make use of the organizations that they control to effect the commission of the crimes. This article analyzes the impact of the theory by Roxin in some decisions of the International Criminal Court
