Franz von Liszt was one the most important specialist on Criminal law and Criminal policy at the end of XIX. Century in Germany. In the field of Criminal Law he strongly supported the rule of law and considered the Criminal Law as a barrier of the Criminal policy. But in the field of recidivist delinquency he was specially worried about that and proposed hard measures of elimination (Unschädlichmachung) and long life prison against recidivists, that influenced strongly the Criminal policy during the National socialism in this area. The article analyzes this double contradictory side of the academic and scientific personality of Franz von Liszt.
