Is the feminicide a gender crime?

Abstract

Hate crimes and gender crimes have come close, and even confused, in the last decades, despite their different historical background. In this paper, we study the relations and limits between these two categories of crimes, de lege lata and de lege ferenda perspectives. We defend that feminicide is esssentially a gender crime. In oder to develop that argument, we start defining hate crimes and gender crimes; latter on, a delimitation of feminicide is provided; and, finally, we critically analyse Spanish regulation of the “reasons related to gender” circumstance, foreseen in the Criminal Code.
