The occupation of a property without violence or intimidation: an unnecessary crime

This article analyzes the crime of occupation without violence and intimidation of property, dwelling or building (art. 245.2 CP) and the consequences of its penalty. It also addresses the extra-criminal protection of possession and delves into the theory of crime as a useful tool to exclude the criminal responsibility of people who commit this crime in situations of social and economic exclusion, while it continues in force.
