The challenges of post-modern criminal law: self-driving cars and negligence in the Italian legal system

Contemporary society is characterised by sudden and overwhelming technological changes. A.I. is transforming our lives and our work. This has a strong influence even on the classic categories of criminal dogmatic, althought criminal law is the most anthropocentric among the legal areas. Assisted or even self-driving vehicles make difficult to identify the subjects who are responsible in case of an accident and it’s even more complex to identify the rules of behaviour on which the negligence is based. About the subjects responsibles, it depends on the degree of automation. More difficult to frame in fees of predictability and avoidability the new events that may occur after the spread of self-drivings car. These are complex issues for which, however, it’s necessary to find answers quickly.
