Criminal policy of the Criminal Code against criminal acts perpetrated with female relevance

Abstract

This contribution carries out a political-criminal analysis of a group of criminal figures who are identified by the female relevance of their quantitative commission compared to the male. To this end, the methodological criteria for classifying criminality with female relevance have been determined. And, according to these methodological criteria, six criminal offenses have been examined: one against family relations, three against property and two against the admi-nistration of justice. The common characteristics of these criminal figures have been established. They are related to the absence of violence, to the situation of poverty and to illegal forms of response to certain family conflicts. As a general rule, the punishment for these crimes is proportional and does not require prison admission, with specific exceptions. Some cases of disproportionate sanctions have been corrected by the jurisprudence of the courts and by the criminal law reform.
