El nuevo Código Penal y la regulación de la violencia intrafamiliar y de género a la luz de las modificaciones introducidas

Abstract

This article deals with the changes introduced by law 1/2015, 30 March, amending the Act 10/1995 of 23 November, of the criminal code, in the field of domestic violence and gender, both with respect to specific criminal types that have been altered as the former introduced ex novo, as well as precepts of the first book of the criminal code affecting the matter directly. Thus between aspects addressed reform of the new minor offences from the threats, coercion and mild humiliation of article 620-2 final paragraph of the old Criminal Code, of the lesions of new article 147-2 New Criminal Code of domestic harassment, and practical aspects regarding the criteria for consideration of offences as minor or less serious to finish with a critique of certain problematic aspects that have already been released of relief by judicial practice and which have not been addressed by the legislator.
